This website is owned and operated by Pick-A-Shift (also mentioned as “the Relief Agency” in the terms and conditions). The terms “User”, “Applicant”, “Job Seeker”, “Pharmacist”, “Assistant”, “Technician”, “Service Provider”, “Independent Contractor”, “Store Owner”, “Store Manager” or “Incorporated Entity” refer to the User accessing this website to find, accept, post or manage relief shifts and assignments.

1. Website Access, Accounts, and Security

  • Account Creation: To access certain features of this platform, including viewing and accepting assignments, the User may be required to register an account. You must provide accurate, current, and complete information.

  • Unauthorized Use: The User must immediately notify the Relief Agency of any unauthorized use of their account or any other breach of security. The Relief Agency will not be liable for any losses caused by unauthorized use of your account.
  • Account Termination: We reserve the right to suspend or terminate a User's account at our sole discretion, without notice, for any conduct that we believe violates these Terms or is harmful to other users or our business interests.

2. Acceptable Use and Restrictions

  • No Data Scraping: The User is strictly prohibited from using any automated systems, bots, scrapers, spiders, or software to extract data, job listings, applicant information, or content from this website for any purpose.

4. Independent Contractor Status & Taxes

  • No Employment Relationship: The relationship between the Relief Agency and the User is strictly that of an Independent Contractor. Nothing on this website or in our digital correspondence creates a partnership, joint venture, or employer-employee relationship under the Employment Standards Act, 2000 (Ontario) or any equivalent provincial legislation.
  • Gross Payments: All agreed-upon compensation for shifts is paid gross. The Relief Agency does not withhold or deduct federal, provincial, or local taxes.

    • Ontario Employer Health Tax (EHT)
    • Applicable Goods and Services Tax / Harmonized Sales Tax (GST/HST)
  • Tax Indemnification: If any regulatory authority reclassifies this relationship as employment, the User agrees to fully indemnify and hold harmless the Relief Agency from all assessed taxes, penalties, interest, and legal fees.

5. Professional Liability and Responsibility

  • Clinical and Operational Responsibility: The User assumes sole, exclusive, and absolute professional responsibility for all pharmacy services, clinical assessments, technical support, and duties performed at assigned client locations.
  • Indemnity: The User agrees to indemnify and defend the Relief Agency and its affiliates against any claims, losses, or damages arising from professional negligence, errors, omissions, or breaches of provincial regulations.
